1. Copy or Original I797A (I129 type)
2. Passport (with H4 visa)

    Hi I have a question regarding the Port Of Entry for my Spouse and Daughter on H4 Visa to the US.

    I was working for Company “A” when my dependents got their Visa stamped. Before they came to the US, I joined company “B” I shared my i797 which I received for company “B”.

    My dependents are planning to join me the next month, so will there be a problem for them at the Port Of Entry as my wife would be carrying the Visa from the company “A” and i797-B from comapny “B”.

    WHat she should answer to the immigration officer if she asked about my employer details, she should give the details about my current employer which is company “B” or the previous employer “A” details who’s Visa is stamped on her Passport ?

      Hi,

      As H4 is valid, your spouse and daughter can travel on the same H4 visa. However, they should carry the new I797 so that at the port of entry, they get I94 (online now days) as per new I797 associated with the new employer. As far as your spouse and daughter carry new I797 and valid H4, there should not be any problem at the port of entry. Yes your spouse should give details about your new employer.

    Hi, Recently my H1B and wife H4 visa got extended and after that we went to India trip where we got our Visa Stamping done. Now the problem is that I started early to US and by mistake I forgot to hand over my spouse I797A original document who is supposed to fly after few days. I did sent that doc by USPS but seems its almost lost. So I need to know can my wife can travel with a copy of her I797A document (not Original) and passport with a visa stamped on it? Will there be any problem during port of entry in US? Please suggest asap thanks in advance.
